Influencer Agreements in Health Tourism

One of the key marketing methods for health tourism facilities and intermediary companies is collaboration with influencers. Through such collaborations, these organizations gain the opportunity to reach the target audience of influencers in the destination country. For such collaborations to proceed efficiently and without problems, the obligations of the parties must be drafted professionally, and potential disputes must be addressed in advance within the agreement based on preventive legal reasoning.


In particular, the legislation of the target country must be legally analyzed, and how the influencer’s performance will comply with this legislation should be specifically outlined in the contract.


It is advisable to prepare the agreement both in the language spoken fluently by the influencer and in English. Mechanisms should be established to verify the influencer’s identity, address, and signature. In addition to health tourism regulations, compliance with tax and personal data protection legislation must also be ensured.


The following points should be addressed in influencer agreements tailored to health tourism companies:

  • Details of the parties

  • Scope of service (the service/product to be promoted, how it will be promoted, platforms, type of content, number of posts, language of publication, etc.)

  • Fee and method of payment, with guarantee mechanisms for high payments

  • Timeline and content calendar

  • Content approval process

  • Intellectual property rights

  • Non-compete clause (commitment not to produce similar content for competitors)

  • Confidentiality

  • Compliance with legal obligations (especially advertising labels, health claims, etc.)

  • Duration and termination terms of the agreement

INFLUENCER COLLABORATION AGREEMENT


Parties:

Article 1 – Subject of the Agreement

This agreement sets forth the terms and conditions under which the Influencer shall promote [services / treatments / health tourism products] provided by the Company via social media.


Article 2 – Scope of Services

The Influencer agrees to share a predetermined number and type of content on the following platforms:

  • Platforms: Instagram / YouTube / TikTok / X (Twitter) / Blog

  • Content Type: [Reels / Stories / Posts / Vlog / Written content]

  • Number of Posts: [ ]

  • Hashtags and Tags: [#companyname #healthtourism etc.]

The content must include a label such as “collaboration” or “advertisement.”


Article 3 – Content Approval and Publishing Schedule

The Influencer shall submit all content to the Company prior to publication and obtain written approval. The timeline is as follows:

Article 4 – Compensation and Payment

In consideration for this collaboration, the Company shall pay the Influencer [total … USD / EUR / local currency].Payment shall be made as follows:[After the work is completed / 50% upon signing the agreement, 50% after the content is published].

If the Influencer fails to perform the service properly or at all, or if the content is removed due to legal non-compliance, no payment shall be made. If payment has been made, it shall be refunded.


Article 5 – Intellectual Property Rights

The intellectual property rights of the created content belong to the Influencer; however, the Company is granted the right to use the content on its own social media channels and in its promotional materials, provided that the Influencer is credited.


Article 6 – Confidentiality

The Parties agree to keep all commercial and personal information acquired during the collaboration confidential and not disclose it to third parties.


Article 7 – Legal Responsibilities

The Influencer agrees that the promotional content will comply with local advertising regulations and relevant health claim standards. No guarantees about treatment results shall be provided, and any unexperienced services or products must be clearly stated as such.


Article 8 – Term and Termination

This agreement shall be valid from [start date] to [end date]. The Parties may terminate the agreement with justified cause by giving at least 7 days' written notice. In case of termination, payment shall be made in proportion to the services rendered.


Article 9 – Dispute Resolution

Any disputes arising from this agreement shall be subject to the jurisdiction of the courts and enforcement offices in [country and city].


Article 10 – Non-Compete Clause

The Influencer agrees that during the term of this agreement and for [3 / 6 / 12] months after its termination, they will not create content of the same or similar nature for, or participate in the promotional activities of, any companies or institutions that directly compete with the Company in the health tourism sector.


In the event of a breach of this clause without prior written permission from the Company, the Influencer agrees to pay the Company [amount in USD / EUR / local currency] per violation.

Examples of activities included in the non-compete scope are:

  • Promotion of similar aesthetic or medical health services

  • Appearing in social media content of competing health providers

  • Collaborating with another brand offering services in the same treatment category
